
Terms of Use of the University Library
I. General Provisions
§ 1 Scope of Application
These Terms of Use apply to Rostock University Library, including its departmental and specialist libraries, in accordance with the Library Regulations of the University of Rostock.
§ 2 Duties of the Library
- The University Library is a central organisational unit of the University of Rostock and, as a public scientific library, serves to support the provision of literature and information at the University. Furthermore, the University Library performs duties with regional and transregional significance in the fields of scientific education, professional work and further education.
- In the course of its duties, it primarily offers the following services:
- provision of various media formats (e.g. books, journals, manuscripts, collections, bequests and electronic media) as well as online, information and communication services;
- provision of items from the University’s collections on the University Library’s premises;
- online access to electronic publications, multimedia products and databases in the context of licensing rights, patent research and archive queries;
- loans of suitable items for use outside of the University Library;
- operation of the central document server “RosDok” as part of the University of Rostock’s Digital Library;
- information, training and classes regarding its electronic and analogue service offering as well as subject-specific advice and information provision;
- the University Bibliography (Universitätsbibliographie) as a central tool for finding publications produced at the University of Rostock;
- sourcing of literature not available on site through domestic and international interlibrary loans within the bounds of applicable copyright law;
- reproductions;
- public relations activities (i.e. exhibitions, guided tours and talks),
- publications; and
- cooperation with faculties, departments and focus areas at the University of Rostock in the scientific examination of information collections in the context of projects.
- The type and scope of services are guided by the specific tasks set of the University Library and by its human, material and technical resources.
II. General Conditions of Use
§ 3 Legal Nature of the User Relationship
The user relationship is fundamentally subject to public law. Agreements under private law may be concluded regarding special uses.
§ 4 Permission to Use the Library
- Use of the services offered by the University Library is regulated by these Terms of Use.
- Anyone wishing to use the University Library must obtain permission to do so.
- In the context of the duties listed in § 2, all of the following natural persons may be permitted to use the University Library:
- members and affiliates of universities in the State of Mecklenburg-Vorpommern;
- all other persons with an officially registered place of residence in the State of Mecklenburg-Vorpommern and who are aged 16 or over;
- other persons permitted on a case-by-case basis by the University Library’s management. Libraries may use the University Library in the context of domestic and international interlibrary loans.
- Registration is required before using the University Library. As a fundamental rule, registration shall be completed in person. Prospective users shall present a valid national ID card or passport during registration. If the person’s place of residence is not evident from the ID presented, they shall also present official documentation to confirm their place of residence.
- Permission to use the University Library is granted through issuance of a library card, which remains the property of the University Library and is not transferable.
- Permission to use the University Library is granted for a limited period (usually one year) but may be extended at any time or made subject to conditions.
- Permission to use the University Library shall be refused if the user fails to acknowledge the Terms of Use of the University Library as binding. This acknowledgement is issued through signature of the registration form. The user relationship commences upon permission being granted. The Terms of Use are available for users to review upon registration and on the University Library’s website.
- Users shall inform the University Library immediately of any changes to their personal details, in particular their name, address or email address if one is registered with the University Library, and in the event that they lose their library card. The user shall be liable for any costs incurred by the University Library due to failure to observe this requirement.
- Visitors can access exhibitions without formal permission to use the library. In such instances, the general provisions regarding behaviour and carefulness set out in these Terms of Use shall apply accordingly.
- The University Library has the right to store the necessary personal data in electronic format for the duration of the user relationship, subject to general statutory data protection requirements. User data shall be deleted no later than one year after termination of the user relationship. If the user has failed to fulfil their obligations to the University Library at that point, their user data shall instead be deleted immediately following fulfilment of these obligations.
§ 5 Expiry and Revocation of Permission
- The user may request that their permission to use the University Library be terminated.
- A user who commits serious or repeated violations of the provisions of these Terms of Use or of instructions issued by University Library staff members may be restricted from borrowing items from the University Library and, following a hearing, may have their permission to use the University Library revoked either in full or in part for an appropriate period (up to six months) by the University Library’s management.
- Stealing or damaging literature, information resources, electronic data storage devices or furnishings represents a serious violation and shall result in action in accordance with § 5(2) of these Terms of Use.
- At the end of the user relationship, the user shall return all items loaned from the University Library. All outstanding obligations shall be met.
- The discharge declaration required for de-registration shall only be issued once all obligations arising from the user relationship have been met.
- The same applies to discharge declarations for departing members of the University of Rostock community.
§ 6 Behaviour in the Library; House Rules
- Users shall behave in a manner that does not does not impair other users’ legitimate entitlements or impede the University Library’s operations. Users are obliged to follow instructions issued by University Library staff. The University Library’s management shall execute the House Rules and may instruct University Library staff members to exercise the House Rules. Users shall follow instructions issued by University Library staff.
- Coats and similar items of clothing, umbrellas, backpacks, bags, laptop carriers and other containers that could be used to carry library materials shall be handed in or stored away, provided that suitable storage facilities are available. Lockers, cloakrooms and cubbyholes used while in the University Library shall be emptied on the same day, at the latest upon its closure for the day.
- Photographs, video recordings and audio recordings of all kinds may only be produced in the University Library with the consent of the University Library’s management. The use of digital cameras, camera phones and similar devices is fundamentally prohibited.
- In all accessible areas of the University Library, users shall remain quiet and avoid disruptive behaviour (i.e. conversations, loud discussions). Smoking is strictly prohibited on the University Library premises. Food and beverages may only be consumed in designated areas. Users may not bring pets with them.
- The University Library may prohibit the use of data processing devices or other devices or limit their use to specific workstations.
- In the interest of all users, the University Library strives to maintain a quiet working atmosphere that enables concentrated and undisturbed work. Users are prohibited from making phone calls (e.g. using mobile telephones) in all publicly accessible areas of the University Library. Devices that produce audible signals when receiving messages or calls shall be switched off in the University Library. Repeated violation of this provision may result in exclusion from using the University Library in accordance with § 5(2) of these Terms of Use.
§ 7 Duty of Care and Liability for Damages
- Library materials shall be treated with care. Stealing, marking in any way, tracing, removing pages, or making any other changes to information resources – including electronic materials – is prohibited. Ink, ball-point pens and other colouring substances may not be used in the vicinity of manuscripts, autographs, maps or plans or any other special collections. Information resources, devices and furnishings may only be used in the designated locations.
- Upon receipt of each work, device or information resource, the user shall examine its condition and completeness and report any pre-existing damage immediately to University Library staff. If no report is made, it shall be assumed that the work was handed over in immaculate condition.
- The user shall be liable for all instances of theft, loss, damage or destruction related to the information resources, devices and furnishings they use, especially for loaned information resources, unless they demonstrate that such theft, loss, damage or destruction occurred through no fault of their own. The user shall pay compensation for any lost or damaged information resources, devices or furnishings in accordance with §§ 249 et seqq. of the Bürgerliches Gesetzbuch – BGB (German Civil Code). The University Library shall determine the form of compensation. In particular, the University Library may demand restoration of the item’s previous condition, procure a replacement copy or another comparable work or copy at the user’s expense, or specify appropriate monetary compensation. The University Library is entitled to issue the user with a notification setting out the level of damage incurred, in particular the costs of replacing the information resources. The same applies to the University Library’s claims for damages resulting from improper use of a library card pursuant to § 4(8).
- If a user’s behaviour during their use of the University Library constitutes a criminal offence, the Rector shall consult the University Library’s management in deciding whether to press charges.
§ 8 Inspections and Lost Property
- All books, journals, items and the like that users bring into the University Library shall be clearly shown to staff. The University Library has the authority to inspect the contents of folders, bags and other containers that users bring with them.
- Upon request, users shall show official ID and their library card to University Library staff.
- The University Library is entitled to inspect all lockers and carrels. Items found in the University Library or not removed from lockers in a timely manner shall be treated as lost property in accordance with § 978 BGB.
§ 9 Copyright and Personal Rights
- The user shall observe the provisions of copyright law, use literature offered in electronic formats for their own scientific purposes, refrain from systematically downloading literature, refrain from disseminating literature or using it for commercial purposes, and comply with all usage restrictions defined by the University Library or the provider.
- The user shall observe third parties’ personal rights in cases where such rights could be affected by their use and processing of the information services offered or mediated by the University Library.
- Third-party use of contact details such as postal addresses, telephone numbers and fax numbers, as well as email addresses that are published on the website as part of the privacy information and terms and conditions, or similar details, for sending information that has not been expressly solicited, is not permitted. We explicitly reserve the right to take legal action against senders of spam emails if this prohibition has been violated.
§ 10 Reproductions
- As a fundamental rule, users may only use the devices available within the University Library to make reproductions, copies (i.e. photographic, electrostatic or digital), microforms or digitalised versions (e.g. multimedia) of the information resources made available on the University Library’s premises and in its collection, while they may use other devices for such purposes in relation to information resources loaned from the University Library’s collection for use outside the University Library.
- Upon request, the University Library can produce or order reproductions (incl. microfiches, microfilms, photographs and digitalised versions) of items from its collections or of library materials it has sourced, provided that it is ensured that the works will not be damaged in the process. Users are solely responsible for observing copyrights, personal rights and all other third-party rights in their use of these reproductions.
- Reproductions of manuscripts, other special items and works that are older, valuable or require special care may only be produced by the University Library or with the University Library’s consent. The procedure is governed by the University Library’s Special Collections Department. The University Library shall determine the type of reproduction. The University Library may refuse or limit reproduction in order to preserve works.
- The University Library may require users to obtain permission before passing on reproductions of its manuscripts, autographs and other particularly valuable items to third parties.
- If the University Library makes the reproduction, it shall retain the rights arising from this; the original reproductions shall remain the property of the University Library.
- Reproduction for commercial purposes (e.g. document provision services, reprints, facsimile publications, postcards, etc.) or in large volumes requires conclusion of a specific agreement that also specifies the service in return. Users may not transfer the right to make and use reproductions to third parties without the University Library’s consent.
- The loan of items for exhibitions or use in photography, filming or TV recordings requires a specific agreement.
- The copyright provisions set out in § 9 also apply to reproductions.
§ 11 Liability of the University Library; Disclaimer
- The University Library shall not be liable for any loss, damage or destruction of items that users bring into the University Library. The University of Rostock shall only be liable for items that are lost or stolen from the storage facilities provided in the event that either intent or gross negligence is demonstrated, but accepts no liability for cash or valuables.
- The University of Rostock shall not be liable for damage resulting from any library services that prove to be incorrect or incomplete, that are not provided or delayed. The same applies to damage resulting from the use of data storage devices, databases or electronic networks. The University of Rostock shall not be liable for damage resulting from the abuse of data by third parties due to insufficient data protection online.
- The University Library assumes no responsibility for the up-to-dateness, accuracy, completeness or quality of the information provided or of its online content. Liability claims against the University Library that relate to material or idealistic damages and were caused by the use or non-use of the provided information or by the use of incorrect and incomplete information are generally excluded as long as there is no proof of negligence or gross negligence on behalf of the University Library. The University Library explicitly reserves the right to change, complement or delete parts of pages or all of the provided information without special notice, or to temporarily or definitively discontinue publication.
- No liability obligation shall exist in relation to direct or indirect links to third-party websites (i.e. hyperlinks) that lie outside the University Library’s area of responsibility. The University Library hereby expressly declares that no illegal content was evident on the linked pages at the time of linking. The University Library has no influence on the current or future composition, content or copyright of the linked pages. Therefore, the University Library hereby expressly renounces responsibility for the content of all linked pages that may have been changed since the pages were linked. This stipulation applies to all links and references on our own website to content that can be edited by third parties. The provider of the linked page shall be solely liable for illegal, incorrect or incomplete content and, in particular, for damages that occur from the use or non-use of such kinds of information, and not such entities that merely refer to the respective publication via links.
- The University Library shall not be liable for the consequences of violations of copyright law by users of electronic workstations. The same applies to contractual obligations between users and internet service providers.
§ 12 Fees, Expenses, Charges and Deposits
- As a fundamental rule, general use of the University Library is free of charge.
- Usage fees and expenses may be charged for certain services offered by the University Library, services mediated by the University Library and offered by third parties, special services and expense reimbursements (i.e. interlibrary loan fees), while administrative fees may be charged for the execution of official acts.
- Fees and expenses are collected in line with relevant state laws governing costs and with the statutes of the University of Rostock regarding the collection of university fees, contributions and charges (Hochschulgebührensatzung (University Fee Regulations)).
- Users shall be liable to pay the charges stated in price lists when ordering reproductions, loaning works for exhibitions or for use in photography, filming or TV recording, using database connections that are subject to fees, or using other special institutions or services offered by the University Library.
- The University Library may levy charges, to be agreed on a case-by-case basis, for the private and commercial use of collections, including for the use of reproductions of manuscripts and other valuable items.
- The University Library may request an appropriate deposit when providing keys to cloakrooms, lockers and other user facilities. If keys are lost and thus require replacement, the user shall be liable for the costs incurred.
§ 13 Opening Hours
The opening hours of the University Library are determined by the University Library’s management and publicised on notice boards and on the University Library’s website. The University Library may be partially or entirely closed for compelling reasons, with notice provided in good time along with the reasons for closure.
III. Use Within the Library
§ 14 General Provisions
- Access to the University Library may be made subject to presentation of a library card.
- The University Library may define special rules of use for the use of computer workstations. The user shall immediately change the initial password for the loan system automatically assigned to them upon registration.
§ 15 Information
- The University Library provides both verbal and written information on the basis of the resources at its disposal, within the scope of its staff and technical resources. In the event that the University Library engages other information services on behalf of the user, the user shall reimburse the University Library for any expenses incurred.
- The University Library accepts no liability for the correctness or completeness of the information provided.
§ 16 Use of Information and Reading Areas, Non-Lending Collections, Textbook Collections and Open Stacks
- All of the media stored and presented in the University Library’s information and reading areas and in the open stacks are available for use on the premises. Media retained by supervisory staff for security reasons may be handed over against a piece of ID.
- Reading spaces cannot be reserved in advance. If a user leaves a reading space for a prolonged period, they must clear the space unless a workstation can be allocated to them on a permanent basis. Otherwise, library staff may clear and reallocate places with items on them but from which the user is absent.
- All works stored in the archives and works owned by other libraries may be requested for use in the reading room. Such works should be collected from and returned to the designated place (reading room desk, Interlibrary Loan Department). Works for use in the reading room are available for up to four weeks. Restrictions may be imposed on the times and locations of use.
- The University Library may concentrate the use of media in certain information centres and reading areas.
§ 17 Use of Computer Workstations
- The University Library offers computer workstations for the use of electronic information resources. Users can login using a valid, non-transferable user ID and password. Users shall acknowledge the Rules of Operation and the Terms of Use of the data communication network (RUN) and the Web Rules of the University of Rostock.
- Use of computer workstations is permitted for official, scientific or study-related purposes. If necessary, the use of computer workstations may be controlled. All non-library-related or commercial uses of IT equipment, including internet access, is prohibited. Non-library-related use is defined as any use that impedes the work or mission of the University Library, violates legal provisions or is contrary to common decency. Use of computer workstations requires basic knowledge of how to use hardware and software.
- Users shall use IT equipment and devices as intended. Users shall immediately report any defects identified before or during use to library staff. Users shall not seek to solve their own IT-related issues. Misprints are the responsibility of the person who submits the print order. Print orders shall be deleted after 48 hours. Users may use their own data storage devices to save files. Users are solely responsible for securing their own files. The University Library is entitled to check data storage devices for viruses before use.
- Users shall take particular note of the relevant provisions of copyright law, licensing law, data protection law and criminal law when using any elements of electronic infrastructure. Violations shall be punished and, depending on their severity, may result in exclusion from use of the University Library.
- The user shall be liable for damage caused by manipulation or other unauthorised use of University Library devices and media. Changes to system settings, network configurations and software are prohibited. Users shall follow instructions regarding the use of devices, databases and internet services. The University Library’s management may issue specific regulations in this regard.
- The duties of care and general principles of liability set out in § 7, § 10 and § 11 shall apply accordingly.
- The University Library shall not be liable for securing usage data or for defective software installations
- University Library staff members may conduct checks and issue instructions, which users shall follow. Users shall operate PCs properly. The equipment provided is solely intended for use on these devices and may not be removed from the University Library. If users encounter technical issues on PCs, they shall inform University Library staff immediately.
§ 18 Use of Special Workstations
The Terms of Use apply accordingly to the use of special workstations (i.e. carrels, group spaces, event rooms, consultation rooms and multimedia workstations, etc.). The University Library’s management may define specific regulations in this regard.
§ 19 Access to Digital Resources
- The University Library provides users with a comprehensive offering of electronic services on its website, including digital journals, databases and e-books, both held in house and provided by third parties.
- Database access is subject to the terms issued by the respective licenser. Freely usable databases are marked accordingly, while restricted electronic information sources (e.g. available only to university members or only available to use on the University Library premises or via dedicated IP addresses at the University of Rostock) are clearly identified as such. An authentication/authorisation program checks access rights.
- In the context of its Digital Library services, the University Library makes the central document server, RosDok, available to users to store and use electronic resources. Users who are members of the University of Rostock may publish their works on the document server as authors. The University Library’s management may issue specific regulations governing the use and operation of the Digital Library
§ 20 Access to the Archive
As a fundamental rule, access to closed archive rooms is not permitted.
§ 21 Use of Manuscripts and Other Special Items
- Manuscripts and other valuable items may only be used upon disclosure of the purpose and in rooms designated for such use by the University Library. Users shall observe the safety precautions required to preserve these items set out in § 7(1).
- The University Library may remove contemporary manuscripts and autographs, in particular bequests, from use for an appropriate period in order to protect personal rights.
- The University Library may conclude separate agreements with users to govern specific details of use of information resources as set out in the preceding paragraphs.
- Text and images from manuscripts and autographs held by the University Library may only be published with the consent of the University Library. The same applies to publications of rare prints and portrait collections. In the event of publication, the user shall be responsible for complying with the provisions of copyright law. Even after granting permission for users to publish content, the University Library shall retain the right to publish the text and images in question or to allow third parties to publish such text and images.
- A specimen copy shall be provided unprompted, free of charge and immediately upon release for all publications from and regarding manuscripts and autographs held by the University Library. The same applies to publications from or regarding rare prints at the University Library’s request. The University Library reserves the right to issue special rules on a case-by-case basis. This provisions of copyright law shall remain unaffected.
- An agreement shall be drawn up regarding creation of a new edition of materials from the University Library’s collections, taking account in particular of loan periods for the purpose of producing scientific editions (of manuscripts, etc.), ensuring the materials’ safety in their place of use, preserving the materials’ original physical condition and guaranteeing the provision of two specimen copies of the new edition free of charge.
- The agreement to be concluded for facsimiles and reprints shall regulate in particular the duration of the loan, the handling of the library materials by the publisher – which shall prohibit and prevent all alterations to the physical condition of the materials not previously discussed and agreed in writing – and the provision of two specimen copies of the new edition free of charge. The reverse side of the title page of a reprint usually features a note indicating that the reprint is based on a copy loaned by Rostock University Library.
- The materials used for a project as outlined in Sub-Sections 5 and 6 shall be returned to the University Library in their original condition. Any necessary amendments – e.g. the removal of old bindings for the purpose of producing a reprint and subsequent rebinding – shall require a written agreement in each individual case. The other contract party shall be responsible for complying with the provisions of copyright law and personal rights.
§ 22 Use of Historical and Special Collections for Exhibitions
- Library materials shall only be loaned for scientific or cultural exhibitions at institutions that provide a guarantee of the exhibition’s proper implementation. Where library materials are loaned for use in exhibitions, a written agreement shall be concluded between the University Library as the lender and the borrower.
- The agreement shall regulate, in particular, the duration of the loan, the transport of the materials, the form of the materials’ return, security measures at the exhibition location including any preservation-related conditions, non-disclosure of the loaned materials to other (travelling) exhibitions, the form in which the lender and loaned materials are referenced in the exhibition catalogue, as well as a requirement to provide a specimen copy of the exhibition catalogue free of charge.
- The borrower shall arrange insurance cover for the borrowed materials against all risks in the amount specified by the University Library.
IV. Lending
§ 23 General Terms of Lending
- The works held at the University Library may be loaned for use outside of the University Library. As a fundamental rule, the following are exceptions to this provision:
- the non-lending collection in the information and reading areas and in the other service areas;
- manuscripts and autographs;
- particularly valuable works;
- works that are over 100 years old;
- works in poor physical condition;
- volumes of plates, maps and atlases;
- journals;
- typewritten PhD theses;
- microforms;
- information materials required for library purposes;
- collections held in special locations; and
- works not suitable for lending due to their physical composition (e.g. loose-leaf editions, etc.).
- The University Library’s management may make other works unavailable for loan or restrict their availability.
- The University Library’s management may define special conditions for short-term loans of non-lending collections, e.g. overnight or over the weekend.
- The use of works subject to high demand may be restricted to the reading room.
- The University Library may limit the number of orders an individual user may place or the number of items an individual user may borrow.
- Information materials of which unlimited use is not permitted due to legal regulations may only be used upon demonstration of a credible academic or professional purpose or a proven research interest. The University Library’s management shall determine both credibility and the scope of use.
- As a general rule, users shall collect the works they have requested in person from the loan desk. As a general rule, users shall personally check out the works they have removed from the open stacks areas by presenting them at the loan desk or by using a self-service machine.
- The borrowing procedure is completed when the works have been recorded in the system and handed out to the user. From that point until the work is returned, the borrower shall be liable for the works, even if they are not demonstrably responsible for any damage.
- Ordered works and reserved works are held for one week.
- The University Library may hand works out to any person who presents the corresponding library card, but is under no obligation to do so.
- Borrowed works may not be passed on to third parties.
- No information will be provided about who currently has specific works on loan.
§ 24 Borrowing Procedure
- Users may borrow items by presenting their library card at the University Library’s loan desks or using self-service machines. The works catalogued in the electronic borrowing system are ordered electronically. Those not catalogued in the system are ordered via a paper-based loan request form. As a general rule, orders using the conventional paper-based route are only permitted in cases where a work is not catalogued in the electronic borrowing system. The machine-based recording of the borrowing procedure serves as proof that a work has been issued.
- Self-service may be permitted for certain procedures at designated terminals. This applies in particular for:
- book queries (title, borrowing status);
- orders;
- loan renewals;
- reservations;
- overviews of a library user’s account; and
- borrowing items using self-service machines.
- If the works have been taken out using a self-service machine, there is no need for a loan request form. When placing an order electronically, users must enter their user number and password.
- In the conventional borrowing procedure, a loan request form must be completed in full for each item. As soon as the work and borrowing slips have been handed over, the loan request form becomes a conclusive receipt.
§ 25 Loan Periods, Renewals, Recall Notices
- The standard loan period is four weeks. The University Library may define a different period depending on usage requirements.
- The loan period may be extended (i.e. a loan can be renewed) if the work is not required by another party and the borrower has fulfilled their obligations to the University Library. Renewals in particular should be processed using the self-service options. Renewals may be refused depending on usage requirements. The user shall check whether renewals have been confirmed in their user account.
- The University Library defines a limit on the number of loan renewals. The University Library may require that the borrowed work be presented in order to confirm a renewal. Renewals shall not be granted for periods that exceed the expiration date on the user’s University Library account.
- The University Library may require a user to return a work before the end of the loan period where necessary for operational purposes. The University Library may issue a general recall for all borrowed works for auditing purposes.
- In cases where works are required on longer loans for research purposes, the University Library may renew the loan period multiple times – without the borrower having to make a specific request – provided that no reservations for the works have been made.
§ 26 Return
- Borrowed works shall be returned to the University Library before expiration of the loan period. Return slips, which the University Library shall issue upon request, serve as proof of the timely return of borrowed works.
- The borrower shall ensure that borrowed library items are returned in a timely manner, including in the event that they are prevented from returning them personally (e.g. due to a prolonged period of stay abroad).
- If a third party is tasked with returning an item, or if a work is placed in a designated book return box outside of the University Library’s opening hours, the user shall immediately check that the return has been completed properly in their library account and report any issues that arise.
§ 27 Overdue Reminders
- If the loan period is exceeded without a renewal request being submitted on time, an overdue reminder shall be issued in writing or via email, specifying an extended deadline. If the item is not returned by the extended deadline, second and third reminders shall be issued, each extending the deadline by 14 days. In these reminders, the University Library shall also reference the legal consequences of failure to meet the deadline. If the user’s email address is on file, the University Library may conduct the necessary correspondence via email.
- The reminder fee shall become due upon issuance of the reminder letter or its dispatch via email.
- Paper-based return reminders shall be considered as received three days after being posted. They shall also be considered as received if they have been sent to the last address provided by the borrower and returned as undeliverable. Return reminders sent via email shall be considered as received immediately.
- If the borrower fails to heed return reminders or fails to pay the fees owed, the University Library may restrict them from borrowing further works and refuse renewals of loan periods.
- If the borrowed work is not returned within 14 days after the third reminder, the University Library may:
- procure a replacement or– if the work is out of print or not available as a second-hand order – demand compensation, or
- impose administrative penalties.
§ 28 Reservations
- Items on loan may be reserved either for loan or for use in the reading room.
- The University Library may limit the number of reservation requests on the same book and the number of reservations per user.
V. Interlibrary Loans
§ 29 Incoming Interlibrary Loans
- Works that are required for scientific purposes and not available on site may be ordered from a different library, with the University Library acting as intermediary in the German and international interlibrary loan systems. Loans shall comply with the provisions of the Leihverkehrsordnung (Interlibrary Loans Regulations) as amended, international agreements and specific conditions issued by the loaning library, with due consideration for § 12(2) of these Terms of Use. The user placing an order shall reimburse all costs incurred in the course of intermediary activities in the international interlibrary loan system.
- Interlibrary loan orders may be submitted either electronically by the user or in a typewritten loan request form by University Library staff. Such orders require accurate information about the requested works.
- The use of media sourced through interlibrary loans is subject to the specific conditions issued by the library providing the work, in addition to the provisions of these Terms of Use.
§ 30 Outgoing Interlibrary Loans
The University Library makes its collections available in the context of the interlibrary loan system in accordance with the provisions of the Interlibrary Loans Regulations as amended. It may exclude certain information resources from external loans.
VI. Other Provisions
§ 31 Exclusion from Use
If a user commits a serious or repeated violation of the provisions of these Terms of Use, or if the continuation of a user account has become unacceptable due to specific circumstances, they may be temporarily or partially excluded from using the University Library. All obligations arising from the user relationship shall remain unaffected after such exclusion.
§ 32 Exceptions
- In other cases not covered by these Terms of Use, special agreements may be concluded at the discretion of the University Library’s management.
- The University Library’s management shall decide, upon request, on exceptions to these Terms of Use.
§ 33 Special Locations
In certain circumstances, the University Library may establish special locations for some of its media. This includes, in particular, e-reserves for specific courses and reference books for institute directors and professors. The University Library’s management defines the organisation and use of such special locations in separate guidelines.
§ 34 Additions to the Terms of Use
The University Library’s management may issue separate implementing provisions in addition to these Terms of Use.
§ 35 Entry into Force
These Terms of Use shall enter into force on the day after their publication in the University of Rostock’s Official Bulletin. At the same time, the Terms of Use in the version of 1 October 1973 shall cease to apply.
